 RULES, REGULATIONS, REQUIREMENTS and REWARDS !


Once paid, you admit that you have read these rules and regulations in their entirety before participating in DEEP CREEK WATERFFOWLERS program aptly named the "QUEST”. These Rules govern THE “QUEST” offered by DEEP CREEK WATERFOWLERS and you understand, acknowledge and unconditionally agree to abide by the following:


  1. All Participants must be a paid DEEP CREEK WATERFOWLERS Club Member,  Each Member/Participant will receive a DEEP CREEK WATERFOWLERS Club Membership / QUEST card upon their joining membership. Additional cards may be purchased or replaced for $5 each !
  2. This program requires photo/s submission/s of harvested waterfowl to participate in the QUEST program. Photo submission/s will be via text to the Club Phone or the website DEEPCREEKWATERFOWLERS.COM
  3. All submitted photos must contain the aforementioned DEEP CREEK WATERFOWLERS “QUEST” LOGO CARD and should not contain any other logo(s), copyright marks, identifying marks, or any other visible references and/or marks with a protected image. Each submitted photo must contain only a single species (only photos with single image of waterfowl will be accepted toward species reward levels) of waterfowl and you may choose to be in the picture or not. These will be the photo/s uploaded on your MEMBERS page within DEEP CREEK WATERFOWLERS website. 
  4. All Members/Participants begin the QUEST at zero waterfowl harvested from the date of sign up and no prior harvested Waterfowl will count toward your forty-one (41). Photos of frozen waterfowl will not be accepted.
  5. All photos must be the Male (Drake)of the species being submitted. DEEP CREEK WATERFOWLERS realizes there are a few waterfowl that are hard to distinguish and will accept either sex of the Mottled or American Black Duck and Geese !
  6. You are not required to provide any title or description for or with image.
  7. All images/photos must be blur free, have an unobstructed view and easily to depict the waterfowl being submitted. 
  8. DEEP CREEK WATERFOWLERS may panel others who consist of anyone of its choosing but with respect to waterfowling and/or subject matter of the photo with purposes to the Quest .This may comprise of Members/Participant or external parties.
  9. Every image uploaded is subject to a moderation process before it becomes visible on the website. DEEP CREEK WATERFOWLERS reserves the right to assess and disregard any submitted photo at its discretion.
  10. Photos that portray or otherwise include inappropriate and/or offensive content, including provocative nudity, violence, human rights and/or environmental violation, and/or any other contents deemed to be contrary to the law, religious, cultural & moral traditions and practices of The United States of America are strictly prohibited and will be immediately discarded.
  11. Any Member/Participant who submits any such photo(s) may be permanently banned, subject to DEEP CREEK WATERFOWLERS discretion, from participating in the QUEST including termination as a member.
  12. The decision/s of DEEP CREEK WATERFOWLERS will be final and binding on any and all matters relating to the QUEST.


INTELLECTUAL PROPERTY RIGHTS


  1. Submitted photos must be original, created and/or taken by the Member/Participant or knowing party. It must not contain any materials owned or controlled by a third party for which you have not obtained a license, must not infringe the copyright, trademark, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity.
  2. DEEP CREEK WATERFOWLERS respects your photos and images. Any Member/Participant shall remain vested by oneself or with the creator of the image but allows DEEP CREEK WATERFOWLERS, worldwide, non-exclusive, royalty free, sub-licensable right and license to use, publish, reproduce, display, perform, adapt, create derivative works, distribute, have distributed, print, in whole or in part, in any form, in all media forms now or hereafter known, to promote DEEP CREEK WATERFOWLERS.
  3. The Member/Participant or photographer/knowing party if so desired may request to be credited for current photo/s and/or image/s entry and its future by sending in a written letter within the first 30 days after submitting said photo/image.


THE REWARDS


  1. (FIRST REWARD), Upon harvesting your Sixteenth (16) different waterfowl species, you will be awarded a short sleeved custom T-Shirt. The shirt will have a DEEP CREEK WATERFOWLERS Logo (front) and DEEP CREEK WATERFOWLERS Quest Logo on back. The rewarded T-Shirt will be only given upon your Sixteenth (16) harvested species of waterfowl and cannot be substituted at a different amount of species harvested. Deep Creek Waterfowlers reserves the right to choice of brand and/or color of T-Shirt And logo.
  2. (SECOND REWARD), Upon harvesting your Twenty-sixth (26) different waterfowl species, you will be awarded a Deep Creek Waterfowlers custom QUEST band and decal !
  3. (THIRD REWARD), Upon harvesting your Fortieth (40) different waterfowl species, you will be rewarded a certificate for a free mount from Wildfowl Creations Taxidermy. This certificate will be good for any duck and simple habitat. The following; Goose, Brant, Sand Hill Crane, Swan and non typical or extreme habit are not eligible with the use of this certificate. However you may use the certificate in exchange for a discounted price of the aforementioned. This certificate can not be transferred, gifted or sold and has no cash value. Any and all additional monies or agreements are payable to or completed with Wildfowl Creations Taxidermy. Wildfowl Creations Taxidermy maintains ownership and participant forfeits rights to mount if custody is not taken within thirty (30) of notice of completion and no prior arrangements are made. Wildfowl Creations Taxidermy reserves the right to change or alter the reward with respects to but not limited to species, habitat, discount or time to finish mount.
  4. First and Second Rewards will be shipped for free within continental United States. Winners from outside the continental United States will be required to cover any shipping expense or transfer fees that would be incurred for such shipping, handling, customs and paid prior to shipping. (Third reward adheres to prior and additionally will be handled on a one on one basis upon redeeming of certificate and agreement reached with Wildfowl Creations Taxidermy).
  5. No reward may be sold, transferred or given/gifted away prior to the Member/Participant taken custody or have received the individual reward achieved. This will null and void the reward(s).
  6. Any state/ provincial/ territorial, and/or local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income tax) on any prize that may be awarded to you under the QUEST program will be solely paid by the member/participant/s if necessary. 
  7. DEEP CREEK WATERFOWLERS makes the final decision(s) on all aspects regarding above reward(s) and reserves the right(s) to substitute reward(s) or cancel reward(s) or the QUEST program at anytime for any reason(s) without the need for written or oral communication. Rewards are awarded based on time stamp of a member achievement in reaching their 16, 26 or 40 species harvested level respectively. The rewards provided will be those in place at the time in which a member actual achieves such goal level and not what may have been in place at time of joining membership.
  8. Any and All additional rewards will be announced as they become available to be added. Additional rewards may be added at anytime and will not be retroactive unless otherwise stated. Those rewards offered by others than that of Deep Creek Waterfowlers will not be guaranteed to be provided.


 


LIABILITY


  1. You hereby hold harmless, release, indemnify and discharge DEEP CREEK WATERFOWLERS and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers and representatives from all liability, claims, judgments, demands, controversies, agreements, damages, actions and causes of action whatsoever, arising out of or related in any way to DEEP CREEK WATERFOWLERS or the QUEST or the conduct of the QUEST and the acceptance and use, misuse, or possession of any reward awarded, whether in law or in equity, no matter what the cause or nature, and you further waive any claims that you may state or assert against DEEP CREEK WATERFOWLERS in association with the QUEST or any of its associated activities, or in any way related to or resulting from the QUEST even if such injury or claims results from or is caused by the negligence or gross negligence of DEEP CREEK WATERFOWLERS, in whole or in part, due to human error or otherwise. You further agree to indemnify and hold harmless DEEP CREEK WATERFOWLERS from any claim arising out of your participation in the QUEST including, without limitation, all claims brought or asserted by any third party as a result of any injury or loss that you or they may sustain in any way associated with your participation in the QUEST.  
  2. Under no circumstance will DEEP CREEK WATERFOWLERS be liable for any:

        a) lost, late, misdirected, stolen, illegible or incomplete submissions

        b) error, omission, interruption, deletion, defect, delay in operation or  transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, submitted photo(s);

       c) problems, failures or technical malfunction of any telephonic network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing;

      d) incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilized in the QUEST or by any technical or human error which may occur in the processing of the photos and/or the submissions; and/or

      e) injury or damage to any participant or to any computer related to, resulting from or in connection with the QUEST.

3. If, for any reason, the QUEST is not capable of being conducted as anticipated, due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of DEEP CREEK WATERFOWLERS, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the QUEST, DEEP CREEK WATERFOWLERS reserves the right at its sole discretion to cancel, terminate, modify or suspend the QUEST as deemed appropriate, including disqualification of any Member/ Participant. DEEP CREEK WATERFOWLERS reserves the right to correct any typo-graphical, printing, computer programming or operating errors at any time without written consent or notice required.

  1. Any and All Rules, Regulations, Legalities, Disclaimers, Waivers, and Requirements found within DEEP CREEK WATERFOWLERS website including its Membership Agreement are to be in conjunction with those of the QUEST program.


GOVERNING LAW


     The “QUEST”, Your Submission(s) and the Rules shall be governed by and construed in accordance with United States laws. Any aspects or disputes arising out of or in connection with the QUEST and/or your submission(s) will be subject to the exclusive jurisdiction of the United States courts.
